🔆TRAIN Law, FAILURE 🔆BIR Collection, Window-Dressed 🔆BIR Commissioner Dulay, CORRUPT 🔆P600-B LGU IRA, shelved by DOF 🔆Ongoing outbreak of COVID-19 Mr. Finance Secretary saan ang Pinas pupulutin? ▪️▪️▪️ May pera ang LGUs Hinarang ni Dominguez President Duterte was overjoyed upon learning of the Supreme Court Decision enjoining the Department of Finance to pay all Local Government Units (LGUs) IRA amounting to P600 billion. Unfortunately, DOF secretary Carlos G. Dominguez 3rd did not enforce the SC decision. P600 billion is such a gargantuan amount of funds for use in the development of the LGUs; more importantly now that our country is experiencing an extremely dangerous catastrophe triggered by the ongoing outbreak of the coronavirus (COVID-19) disease. Why did the secretary not enforce the SC Decision considering that even President Duterte had proudly announced that this administration has the money? Two Truth Expositors or "whistleblowers" (MSM writers prefer to use the word "whistleblowers") here against gargantuan corruption in Philippine government have been waging their respective Don Quixotic krusada kontra darambong or plunder involving many billions of pesos = Othello Dalanon versus the BIR bribe industry racketeers and Melchor Magdamo versus the COMELEC Smartmatic mafia. Unlike many other noisy politico-whistleblowers with questionable ulterior motives, such as those who were initially co-conspirators in corruption before deciding to expose (for immunity), both Othello Dalanon and Melchor Magdamo have no derogatory record in public service. On the contrary, their motive for "blowing the whistle" arose from pure desire to reform their respective bureaucracies. Moreover, their extensive public service experience gave them immense expertise in their specialties = Dalanon on Tax + Magdamo on Polls. Now they are joining forces to converge w...

PRRD Failed To Make Good His Words

Image
PRRD failed to make good his words. President Duterte promised to ease the Filipino people from the burden of tax, but his economic team's TRAIN Law instead doubly raised the burden of tax that falls on the people with greater impact on the common tao. He also promised to rid the government of corruption, particularly the Bureau of Internal Revenue (BIR) which he tagged as the most corrupt government agency since time immemorial, but his deafening silence on BIR Dulay corruption clearly demonstrates tolerance to his friend and former YMCA Dormitory room mate BIR commissioner Caesar Rivera Dulay’s corrupt practices. It's been two (2) years now since the President was officially informed of the corruption issue involving Dulay thru the former BIR Director Othello Dalanon’s letter-report, but the President remains mum about it. The BIR DULAY CORRUPTION has also been publicly exposed via - ✅Social media or Facebook postings; ✅Publication in MSM: ▪️The Manila Times ...

President Duterte: Report The Truth, Even If It Destroys Me

Image
President Duterte: “Report the truth, even if it destroys me.”                       👊  👊  👊 SWS survey says "excellent" rating for President Duterte. Meanwhile, the Corruption Perception Index published by Transparency International reveals that corruption in the Philippines has worsened under the current administration? Did SWS also conduct a survey on issues like Economic Policies (i.e. taxation system) and Corruption? Would such an extremely impressive or perfectly high rating make the President feel comfortable? Perhaps, the President just wants to hear a fair and reasonable report on his administration. While it is correct that he may have succeeded in some of his commitments for the betterment of our country, he may have fallen short on other aspects. He is not perfect, he surely knows that. He even honestly admitted that he failed on his promise to end corruption in government. That he alone canno...

Internal Revenue Allotment Or IRA Is The Share Of The Local Government Units From Revenues Of The National Government

Image
Internal Revenue Allotment or IRA is the share of the Local Government Units from revenues of the national government. The term "revenues of the national government" refers to all revenues or national taxes collected by the BIR, BOC, and other national government agencies. Some years back, Batangas Governor Hermilando Mandanas filed before the SUPREME COURT a case against the national government for misappropriating LGUs' Internal Revenue Allotment (or share in the national taxes) by considering only BIR's revenues in determining IRA without including revenues collected by the BOC and other national government agencies thereby resulting in the deficiency IRA amounting to P600 billion. Governor Mandanas won the case. The SUPREME COURT, in its final decision (G.R. No. 199802 and G.R. No. 208488 decided 2018-07-03 final since 2019-04-10), ordered the Department of Finance (DOF) to pay all LGUs P600 billion IRA. President Duterte was overjoyed upon learning...

President Duterte Trustingly Said That His Government Has Money. "Sinasabi Ko Na Sa Administrasyong Ito, WE HAVE THE MONEY," He Said.

Image
President Duterte trustingly said that his government has money. "Sinasabi ko na sa administrasyong ito WE HAVE THE MONEY," he said. But why did DOF secretary Dominguez not enforce the SUPREME COURT decision (G.R. No. 199802 and G.R. No. 208488 decided 2018-07-03 final since 2019-04-10) ordering the Department of Finance to pay all Local Government Units (LGUs) Internal Revenue Allotment or IRA amounting to P600 billion - even on staggered bases?  Is the secretary's refusal to pay - even on staggered bases - not a clear indication that the government is actually short of money? What happened to the much-vaunted TRAIN LAW which has been in effect since January 1, 2018 yet? Is it not that the secretary was the principal architect of the TRAIN LAW? Is it not that the TRAIN LAW was purposely crafted to raise more revenues for the government? Is it not that the BIR proudly announced that it was able to collect P2.17 trillion even if approximately 7% short of...

TRAIN LAW

Image
TRAIN LAW Taxes are the lifeblood of the nation. Without it, the government will be paralyzed for lack of motive power to run its affairs. However, taxation must be equitable (i.e., that burden of tax should fall on those better able to pay). TRAIN was crafted to raise more tax revenues. However, while it increases the burden of tax that falls on the ordinary people, it lessens the load of those better able to pay. TRAIN is significantly unfavorable to the Filipino people with greater impact on those earning below the minimum wage, while extremely favorable to oligarchs. The same will not entirely boost tax revenues in spite of the increases in excise tax and tax rates imposable on sale of shares of stock traded and not traded in the local stock exchange as it can be offset by the extreme drop in transfer taxation. On 19 December 2017, PRRD signed into law RA No. 10963 otherwise known as the TRAIN that took effect on 01 Jan 2018. The Act amended several provisions of RA ...

Is SWS "Excellent" Rating For PRRD Not Just Meant To Flatter Him?

But the Corruption Perception Index published by Transparency International reveals that corruption in the Philippines has worsened under the current administration? Duterte Tolerates Dulay Corruption

President Duterte Urged the Public to Assert Fight Against Corruption

President Duterte urged the public to assert fight against corruption. He even promised to incentivize those who will report and to immediately act on reports against those involved in corrupt practices.  But who else can have the audacity to report corruption in government if it would only mean dismissal from the service just like what happened to former BIR Director Othello Dalanon who was sacked for reporting BIR Dulay Corruption to President Duterte? Malacanang Urges Public To Report Corrupt Government Workers

Image
Malacanang urges public to report corrupt government workers. OhMyDulay! Who else can have the audacity of reporting corruption in government if it would only mean dismissal from the service just like what happened to the former BIR Director Othello Dalanon who was sacked for reporting BIR DULAY CORRUPTION to President Duterte and senator Bong Go? Dalanon was PRRD’s appointee as Director 1 in the Bureau of Internal Revenue assigned to the Office of the Commissioner where he discovered and exposed the worst corruption ever in BIR history involving the highest-ranking official of the agency BIR commissioner Caesar Rivera Dulay himself - in the extremely anomalous settlement of Cosmos’s P3.76 billion deficiency tax liabilities for only P51 million which the Court of Tax Appeals, in its Final Resolution (CTA Case No. 9405 dated 25May17), ruled as invalid. The said CTA final resolution states, among other things, that - 1️⃣Cosmos’s P3.76 billion deficiency tax liabilities h...
