Dominguez Shelved LGUs' P600-B IRA
President Rodrigo Duterte wanted to pay LGUs' P600 billion IRA as ordered by the Supreme Court, but Finance Secretary Carlos G. Dominguez SHELVED it.
Internal Revenue Allotment or IRA is the share of the Local Government Units from revenues of the national government.
The term "revenues of the national government" refers to all revenues or national taxes collected by the BIR, BOC, and other national government agencies.
Some years back, Batangas Governor Hermilando Mandanas filed before the SUPREME COURT a case against the national government for misappropriating LGUs' Internal Revenue Allotment (or share in the national taxes) by considering only BIR's revenues in determining IRA without including revenues collected by the BOC and other national government agencies thereby resulting in the deficiency IRA amounting to P600 billion. Governor Mandanas won the case.
The SUPREME COURT, in its final decision (G.R. No. 199802 and G.R. No. 208488 decided 2018-07-03 final since 2019-04-10), ordered the Department of Finance (DOF) to pay all LGUs P600 billion IRA - even on staggered bases.
President Duterte was overjoyed upon learning of the Supreme Court Decision and vowed to explore and find a way to implement the SC decision. Unfortunately, DOF secretary Carlos G. Dominguez 3rd did not enforce the said SC decision allegedly because the government does not have money. The secretary wants it enforced in the next administration.
But why wait for the next administration?
Is the secretary's refusal to implement, even on staggered bases, consistent with President Duterte’s pronouncement that the government has money? "Sinasabi ko na sa administrasyong ito WE HAVE THE MONEY," PRRD said.
What happened to the much-vaunted TRAIN LAW which has been in effect since January 1, 2018 yet?
Is it not that the secretary was the principal architect of the TRAIN LAW?
Is it not that the TRAIN LAW was purposely crafted to raise more revenues for the government?
Is it not that the BIR has proudly announced that it was able to collect P2.17 trillion even if approximately 7 percent short of its P2.330 trillion revenue goal for year 2019, not to mention that it was actually WINDOW-DRESSED to trick the President?
P600 billion is such a gargantuan amount of funds for use in the development of the LGUs; more importantly now that our country is experiencing an extremely dangerous catastrophe triggered by the ongoing outbreak of coronavirus (COVID-19) disease.
Had secretary Dominguez not suspended payment thereof, all LGUs could have already received their respective shares even on staggered bases.
